Terms of Service

Welcome to Red Collar Consulting. These Terms of Service govern your use of our SMS communication program. Our broader labor organizing consulting engagements are governed by separate agreements with our clients and campaigns.

1. Description of Messaging Services

Red Collar Consulting utilizes SMS messaging to communicate with clients and contacts regarding our labor organizing consulting services. By opting into our messaging program, you may receive messages related to meeting reminders, attendance follow-ups, outreach to interested workers, interview scheduling, and event notifications.

2. Eligibility

To opt in to our SMS messaging program, you must be at least 18 years old and either the owner of the mobile number provided or otherwise authorized to consent to receive messages at that number.

3. User Consent and Opt-In Acknowledgment

By providing your mobile phone number and verbally consenting during a service request, meeting, or event, you agree to receive SMS communications from Red Collar Consulting. You acknowledge that consent is not a condition of purchasing any property, goods, or services.

4. Opt-Out Instructions

You can cancel the SMS service at any time. Just text STOP to the short code or number from which you received the message. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

5. Help Instructions

If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at [email protected].

6. Message and Data Rates

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies (typically 2-5 messages per month). If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

7. No Third-Party Marketing Commitment

In compliance with A2P 10DLC requirements, we are committed to protecting your privacy. Mobile information and messaging consent will not be shared with any third parties or affiliates for marketing or promotional purposes.

8. Carrier Liability

Carriers, including but not limited to AT&T, T-Mobile, and Verizon, are not liable for delayed or undelivered messages.

9. Limitation of Liability

To the fullest extent permitted by law, Red Collar Consulting will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, our SMS messaging program. Our total liability for any claim arising from the messaging program will not exceed the amount, if any, you paid us to participate in it.

10. Governing Law

These Terms of Service are governed by the laws of the State of New York, without regard to its conflict of laws principles.

11. Modification and Termination Rights

We reserve the right to modify or terminate our SMS messaging services, or these Terms of Service, at any time. If we make material changes to these Terms, we will update the "Last Updated" date above. Your continued participation in our messaging program after any changes constitutes your acceptance of the revised Terms.
